Terms and Conditions

1.            Introduction

These Terms and Conditions ("Terms") govern your use of the JOBIPRO mobile application ("App") and the services provided therein. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

2.            Description of Service

JOBIPRO is a platform that connects service providers with individuals seeking services. Users can post job requests specifying their requirements, and service providers can apply to fulfill those requests by submitting quotes.

3.            User Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are of legal age to form a binding contract with JOBIPRO.

4.            Account Registration

To use certain features of the App, you may be required to create an account. You agree to provide accurate and complete information during the registration process and to keep your account credentials secure. You are solely responsible for all activities that occur under your account.

5.            Posting Jobs

Customer may post job requests within specified service categories. By posting a job, you agree to provide accurate and detailed information about the job requirements. You acknowledge that JOBIPRO does not endorse, screen, or verify the accuracy of job postings.

6.            Service Provider Applications

Service providers may apply to jobs posted by Customer by submitting quotes. By submitting a quote, service providers agree to provide services in accordance with the job requirements and their submitted proposal.

7.            Payment Terms

Payment for services rendered through the App shall be made directly between the Customer and the service provider. JOBIPRO is not involved in the payment process and does not guarantee the quality or completion of services.

8.            Non-Refundable Payments

•             Payments made by service providers for monthly subscriptions, advertising, or any credits bought through the App are all non-refundable.

•             Service providers acknowledge and agree that they will not receive a refund for any payments made, regardless of the usage or duration of the service.

•             Service providers are responsible for ensuring they understand the terms and conditions of any payments made through the App.

•             JOBIPRO reserves the right to change its pricing and payment policies at any time, and will notify service providers of any changes in advance.

9.            User Conduct (Customer and Service Provider)

Users agree to use the App in compliance with all applicable laws and regulations. Users shall not post any content that is defamatory, obscene, unlawful, or infringes upon the rights of others. JOBIPRO reserves the right to remove any content that violates these Terms.

10.          Intellectual Property

All content and materials available on the App, including but not limited to text, graphics, logos, and images, are the property of JOBIPRO or its licensors and are protected by copyright and other intellectual property laws.

11.          Privacy Policy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and disclose your personal information.

12.          Service Provider Badges

•             Liability Insurance Badge:

•             Description: Awarded to service providers who have valid liability insurance.

•             Requirements: Service providers must upload their liability insurance documents. The documents must match the service provider's or contractor's name or business name. The insurance must have a valid expiration date. Service providers must update the document upon expiration to maintain the badge.

•             Benefit: Indicates that the service provider is insured, offering clients peace of mind and increasing trust in the provider's services.

•             Police Record Check Badge:

•             Description: Granted to service providers who have completed and passed a police record check.

•             Requirements: Service providers must upload their police record check documentation. The document must be current and match the service provider's name.

•             Benefit: Assures clients that the service provider has a clean background, enhancing the provider’s credibility and trustworthiness.

•             Trade License Badge:

•             Description: Given to service providers who hold a valid trade license for their specific services.

•             Requirements: Service providers must upload their trade license. The license must be current and match the service provider’s name or business name. The license must cover the specific trade or services offered by the provider.

•             Benefit: Confirms that the service provider is licensed to perform the services they offer, ensuring clients of their professional qualifications and compliance with industry standards.

•             Badge Display and Requirements

•             Service providers must complete the relevant actions or meet the specific criteria to earn each badge.

•             Badges are displayed prominently on service provider profiles to enhance credibility and attract more clients.

•             JOBIPRO reserves the right to revoke badges if a service provider fails to maintain the required standards or engages in any conduct that violates these Terms and Conditions.

13.          Customer and Service Provider Reviews

•             Reviews given to service providers can only be submitted by customers who have received services from them.

•             Each customer can provide one review per service provider, but they can edit their review at any time.

•             Reviews help build the service provider's profile credibility and trustworthiness.

•             Service providers have the option to report any review if they believe it is incorrect or unfair.

•             JOBIPRO reserves the right to investigate and take appropriate action on reported reviews, including removal if necessary.

14.          Termination

JOBIPRO reserves the right to terminate or suspend your access to the App at any time for any reason without prior notice. Upon termination, your account and all associated data may be permanently deleted.

15.          Disclaimers and Limitation of Liability

The App is provided on an "as is" and "as available" basis. JOBIPRO makes no warranties or representations regarding the accuracy or completeness of the App's content. JOBIPRO disclaims all warranties, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, or non-infringement. JOBIPRO will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.

16.          Indemnification

You agree to indemnify and hold harmless JOBIPRO, its affiliates, and their respective directors, officers, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the App; (ii) your violation of these Terms; or (iii) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right.

17.          Changes to Terms

JOBIPRO may update these Terms from time to time without notice. It is your responsibility to review these Terms periodically for any changes. Your continued use of the App following the posting of changes constitutes acceptance of those changes.

18.          Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada. Any disputes arising out of or relating to these Terms shall be resolved exclusively by the courts of Ontario, Canada. Each of the parties hereby attorns to the exclusive jurisdiction of the provincial and federal courts located in the province of Ontario with respect to any dispute or claim arising out of or in connection with the terms of service.

19.          Prohibition of Political and Sexual Content

•    Users are strictly prohibited from posting any content related to politics or sexuality. Any such content will be immediately removed from the platform.

•    First-time offenders will receive a warning.

•    Repeat offenders will be banned or blocked from the platform.

•    Users who are banned or blocked for violating this policy will forfeit any remaining credits

20.         Customer and Service Provider Accountability

•  If a contractor or service provider receives an upfront payment or deposit from a customer and then abandons the job, they will be banned from our platform until the issue is resolved with the customer. A yellow flag will be added to their account for six months, warning other customers to exercise caution. During this period, the service provider or contractor will be required to pay double for the subscription or credits. If the contractor or service provider maintains good conduct during this period, the yellow flag will be removed after six months.

•  If a customer fails to pay the service provider in full or attempts to evade payment or breach the contract, they will be banned from our platform until the issue is resolved with the service provider. A yellow flag will be added to their account for six months, warning other service providers to exercise caution. If the customer maintains good conduct during this period, the yellow flag will be removed after six months.

21.     Intellectual Property Protection

All content and materials available on the App, including but not limited to text, graphics, logos, images, code, and other functionalities, are the property of JOBIPRO or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws. Users agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App without prior written permission from JOBIPRO.
